SID has had its differences with Ms Reding over the RFID threat back in 2007 and we expressed our criticism, but by 2009 the gap between us had narrowed significantly. Now the time has come to defend her.

First a general comment on the Sarkozy/Roma crisis. If it is discovered that a crime has been committed the police looks around for suspects and evidence. If it finds enough evidence against a suspect, the file is handed on to the prosecutor. If the prosecutor agrees that the evidence is sufficient s/he brings the case to court. If the judge(s) agree that there is enough proof against the accused a criminal penalty is imposed. One such penalty is to be banished from the country.

All of this is as simple as it is boring; the due process of law.

The problem is that none of the 300+ repatriated Europeans has been convicted of even the least misdemeanour, not to mention felonies. All we hear are generalisations. In Europe, as in Guantanamo, hearsay is not evidence.

What about Luigi, who we are told touched off this confrontation by getting himself killed at or near a police checkpoint? Media report different versions of what happed, but it is expected that inquiries will find that Luigi is 100% responsible for the decision of a police officer to pull the trigger. After all, the Serpicos are few and far between , which is easy to understand when one remembers what his colleagues did to Frank for being too frank. Perhaps we will know more about the truth in a few decades decades.

Ms Reding's words are available here. Some politicians have used small lapses that were made in righteous anger as an excuse to distance themselves from her and thereby from the Charter of Fundamental Rights. But remember Mr Sarkozi's famous reference to cleaning up the messy suburbs with a "Karcher"? That was more than just product placement for a German corporation. First; the Karcher is used to remove stubborn filth from buildings. People far to the left of the Front National will have easily understood the implication that the dark skinned young trouble makers have no humanity and therefore no human rights. Second; when misused, Karchers can cause injury and death. If Ms Reding chooses to apologize for this or that word it is due to her good upbringing and her willingness to cooperate, but she is under no moral obligation to do so, no matter how many crocodile tears are shed.

From time to time, SID is criticized for going beyond income issues so often and so far. We are pro actively defending our own organisation because unions cannot survive long without the rule of law and fundamental rights. True, what happened in France is tiny compared to offences in the Iran and the Mediterranean that we have previously criticized. But the 27 Member States have signed up to the Charter of Fundamental Rights. Let's keep Europe ahead of the Near East in human rights.

A few weeks before Hitler became Chancellor ((http://en.wikipedia.org/wiki/Niemoeller|Martin Niemoeller)) met with him. Hitler reassured Niemoeller that there would be neither "ghettos" nor "pogroms" in Nazi Germany. Hoping for the best, Niemoeller went home and kept quiet until the Gestapo picked him up and put him in the concentration camp at Sachsenhausen. Looking back on his mistake, he said;
"First they came for the communists, and I did not speak out-- because I was not a communist;

Then they came for the socialists, and I did not speak out-- because I was not a socialist;

Then they came for the trade unionists, and I did not speak out-- because I was not a trade unionist;

Then they came for the Jews, and I did not speak out--
because I was not a Jew;

Then they came for me

and there was no one left to speak out for me." (Read more here.).

It is very nearly certain that the French centre right of the 21st century will never go as far as the German fascists of the 1930s and 1940s. But the core of Niemoeller's message applies at all times in all places; defend everybody's fundamental rights, not just your own.
If you wait, it could be too late.

SID is one trade union that heeds Niemoeller's warning.
That is why we are proud to back up Ms Reding.
