The European Commission private employes with Luxembourgish law contracts (EDLs)
We, who are the private employees (les employés privés de droit luxembourgeois - EDL) of the European Commission, having been selected, recruited as educators and child minders by the European Commission and are being directly paid by it, have decided to present ourselves as candidates for the election to the Local Staff Committee. Why?
1) cf. Art. 7 RAAA " candidatures of non officials are only acceptable if their contract is for more than one year or for an indefinite period ..."
2) We have contracts of duration indefinite period
3) Our candidatures is refused
4) We are not amongst the other agents of the Commission, but considered as the personnel educators of the CPE in Luxembourg (approximately 65 persons including the administrative medical Staff and educators of the Commission)
5) We have a legitimate personnel delegation to defend our legal Rights, our contracts based on Luxembourgish law, but considering the statutory law the Luxembourgish law does not recognise European trade unions
6) The Local Staff Committee of the European Commission is an entity that is not considered as a trade union where all of the personnel could present themselves or be represented
7) that could defend our work conditions, our daily problems in the CPE ( extra-territoriality conditions do not permit us, this is the reason why our personnel delegation is not invited)
8)SID via the intermediary of Mr Fardoom has proposed our candidatures in order for the EDL educators of the Commission to be able to be represented in Brussels, in order that the EDL educators could finally evoke their working conditions, their daily problems
9) Our candidatures were refused but we are indebted to SID for considering our cases, and with whom we have managed to show a new incoherence in the call for the candidature of the local Staff Committee elections
10) Finally, even though the private employees of Commission are becoming extinct why cannot they be considered as other servants of the Commission?
