Disunited Behind Closed Doors, Part II

We reported earlier on the divisions inside what should really be called the "Disunion Syndicale" and how they spill over into the work of the Luxembourg Staff Representation. Meanwhile Ms Souka, Director General of Human Resources has made a decision for the Staff Committee.
The operative part is this;
"7. In fact, the Rules of Procedure contain no provisions concerning the circumstances in which the mandate can be terminated, although Article 27 appears to assume (wrongly) that the LSC-LUX can do what it likes when it likes). On the other hand, the Commission Decision does contain such rules – and the Commission Decision is of higher rank. The legislature made the institutions responsible for determining the composition of the central staff committee precisely because it is the central committee: thus the circumstances in which a member's mandate could be terminated should be the same for all members, whichever local committee appointed them. It cannot be left to a local committee to determine unilaterally how the central committee is to be composed at any given moment, by deciding itself when a member's mandate can be terminated."

This raises questions about why Luxembourg should have election rules which are different from those of all other sites, and much less democratic. If the " circumstances in which a member's mandate could be terminated should be the same for all members", then there is reason to demand that sameness for entry into the Central Staff Committee. Why should Luxembourgers be allowed to " determine unilaterally how the central committee is to be composed at any given moment"? Perhaps one happy day, we too will enjoy proportional representation.

Here is the conclusion, worded as a polite order to the Luxembourg Staff Committee;

"In the light of the foregoing, in my capacity of Appointing Authority entrusted with the powers of control over the legality of the acts adopted by the statutory bodies, I invite the LSC-LUX to annul the revocation of Mr Delgado - Saez as a member of the CSC and to confirm his appointment as a full member of CSC in the LSC-LUX delegation to the CSC."

First criticism; the majority of the Disunion Syndicale is so dedicated to crushing the minority that it resorts to tactics which are arguably illegal.

Second criticism; that majority has dragged its internal war out into the Local Staff Committee which has nothing to do with it.

Third criticism; being unable to co-exist with its minority, the majority has deliberately opened the door to management intervention in staff representation, always problematic.

Fourth criticism; neither the majority, nor the minority have explained to staff what it is they are fighting over. Until they reveal their reasons to staff, it is fair to suspect that the internal struggle of the Disunion Syndicale is so dirty that they fear transparency.

Fifth criticism; all of this infighting is consuming the Disunion Syndicale's energy at a time when staff needs everyone to focus on the "Reform" which is planned to reduce our package by 26.5% all losses added up.

It is understandable that readers may be revolted by this spectacle of "political power at any prize". Before you turn your back on staff representation, please remember that the Disunion Syndicale is not the only union. There are also small, but independent unions that practise internal grassroots democracy and have never received a EURO cent from DG HR, nor from anyone except staff members.
