Discrimination against Contractual Agents


The EC is going to organise internal competitions open only to officials and temporary staff.

The internal competition is not open for contractual agents. Why? Because, such a rule is inscribed in the Staff Regulation.

It is a clear restriction to the competition process and a violation of the equal treatment. It is a kind of discrimination.

For reasons of transparency and equal treatment no internal competition should be organised in such a way. It should be open for all. Internally for all internal staff - actually under the contract - it does not matter which one (Official, CA and TA).

Externally - open for all - from inside of the institutions and from outside.

When DG ADMIN organises the compulsory trainings for all newcomers to the Institutions, it is said that except the time of the contract, there is no difference between Officials, CA and TA. But the further you go; the more you discover some small differences in treatment of employees by the employer, because of the contract signed.

So it means that the equal treatment of the employees is only a catch-phrase. This is confirmed by the restricted access to the internal ongoing competition.

The 10 new Member States seem to be treated in the special way. When somebody from these new countries starts his job in the EC, everybody speaks about the quotas for new Member States that DG has to fulfil.

It doesn't matter if you are engaged as CA or TA. But when you look at the Communication from Vice-President? Mr.Kallas of 01/10/2008 SEC (2008)2584 -'Recruitment de Fonctionnaires et d'Agents Temporaires des Nouveaux Etats Memebre au sein de la Commission' - there is nothing about CA, only Officials and TA are taken into account. So what happens with all those CA who are engaged to fulfil the quotas and then they disappear in the statistics?

There is no link between the quotas and the kind of contract you are engaged with. It would be very interesting to know how many CA are engaged from 10 new Member States and if they fulfil any quotas or not. When you look at the statistics nearly 25% of the staff from 10 new Member States were engaged under a TA contract. And right now 4,5 year after accession the special internal competition is organised especially for those who have escaped from EPSO procedures.

The international organisation must develop constantly. It is obvious! It should use in the best way all its resources. No organisation should deprive itself of the experience acquired by the part of its personnel.

Why does EC do this?

This is a waste of resources, when experienced personnel is partially excluded from the possibility of participation in the competition. The time and money spent on their training, preparation to work on the given post, all the administrative actions around each person seems to be only a short term investment and is completely useless in the long term.

The work of recruitment must start again. Looking at the increasing number of CAs and the experience they acquire during their contracts within the Institutions, it seems to be strange that the EC may entrap itself in restrictive procedures vis-à-vis CAs. All the experience acquired by CA is lost for the Commission when they finish their contracts.

There is another aspect of such a restricted procedure - demotivation of the personnel who must think all the time what will happen to them after the maximum 3 years of contract. Such a restricted competition procedure shows what a low value the Institution attributes its CA.

On the other hand, people who were TA for two years and switched their status to CA for the next 3 years are also in the situation of discrimination. They can not apply because they changed their contract status.

Their experience represents no value for the organisation, because they changed their status, their applications will be blocked because of the principle of "for Officials and TA only".

Maybe some time ago there were not so many Contractual Agents and they did not express their opinion loudly, but after 2004 Staff Regulation reform the situation has changed. More and more CAs were engaged by the COM Services - especially from new Member States.

In reality they do the same tasks as Officials and TAs. There would have been more voices against this incoming internal competition if it would be organised for all Member States, not only for new ones.

It is time to end such a procedure, where the lack of transparency and unequal treatment are obvious.

It is time to change this part of staff regulation. It often happens that the regulation does not reflect the reality.

The upcoming internal competition should be extended to the all internal staff or it should be annulled and then open for all.

Internal competitions


The Commission may organise competitions internal to the institution, which are open to officials and temporary staff of the Commission.
Upcoming internal competitions:

  • Assistants AST1 (COM/INT/EU10/08/AST1) having the Cypriot, Estonian, Hungarian, Latvian, Lithuanian, Maltese, Polish, Slovak, Slovenian or Czech citizenship.

  • Assistants AST3 (COM/INT/EU10/08/AST3) having the Cypriot, Estonian, Hungarian, Latvian, Lithuanian, Maltese, Polish, Slovak, Slovenian or Czech citizenship.
  • Field 1 : administrative assistant
  • Field 2 : direction secretary

  • Administrator AD5 (COM/INT/EU10/08/AD5) having the Cypriot, Estonian, Hungarian, Latvian, Lithuanian, Maltese, Polish, Slovak, Slovenian or Czech citizenship.

  • Head of Unit AD9 et AD12 (COM/INT/EU10/08/AD9 and COM/INT/EU10/08/AD12) having the Cypriot, Estonian, Hungarian, Latvian, Lithuanian, Maltese, Polish, Slovak, Slovenian or Czech citizenship.

  • Head of Unit AD9 in the field of interpretation - Hungarian (COM/INT/SCIC/08/AD9/HU) and Polish (COM/INT/SCIC/08/AD9/PL) Linguistic Units

  • Administrator AD8 (COM/INT/OLAF/08/AD8) and AD10 (COM/INT/OLAF/08/AD10) specialized in the fight against fraud.
