The Court of Auditors; Warnings About the Draft (New) Staff Regulations


In June 2012 the Court of Auditors issued an opinion on the Commission's draft of the new Staff Regulations. This is the full text. We call your attention to some highlights.



"9. The Court recommends that the institutions report annually on the steps taken to meet the planned objectives of reducing staff numbers by 5 % by way of not replacing a certain number of departures, i.e. those who retire and those whose contracts come to an end. Reporting should demonstrate that the objective to reduce costs is not circumvented, for example by using third party service providers, since such staff do not feature in the headcount."

As was expected, the Court of Auditors agrees with the reductions in posts. SID takes the opposite view, but the warning against shifting costs to other budget lines by turning civil service posts into precarious contracts at a higher final cost is valid.

The people working for contracting companies usually receive lower salaries than we do. But the taxpayer ends up paying for the management overhead and the profit of the company that benefits from creeping privatization. It is clear that privatisation transfers another slice of Europe's GDP from the 98% to the wealthiest 2%. In exchange, we get the promise of greater efficiency which is not always fulfilled. A large scale example of expensive privatization is that of British railways. On a much smaller scale we have that of the party celebrating Cypriot and Maltese accession to the Monetary Union, which was contracted out. The company invited Cypriot colleagues twice and the Maltese not at all. Those who found out from Cypriot co-workers were sternly turned away at the door for lack of an official invitation and are waiting for their party to this day. That private contractor was as incompetent and bureaucratic as the very worst among us.


"Changes to the career structure
12. The proposal introduces a new staff category ‘AST/SC’ for secretaries and clerks in addition to the existing function groups for administrators (AD) and for assistants (AST). The pay level proposed for AST/SC entry grades will, in some circumstances, make it difficult to recruit staff with the linguistic skills required by the nature of the institutions’ work and to maintain geographical balance."
The traditional role of the Auditors has been to keep expenses down. When they warn that pay in the lowest categories as planned will be too low, that raises an alarm. The AST/SC are an important link in the chain which holds the system together, just as important as any link. The Court of Justice, which has high linguistic standards, is already stretching the current regulations in order to boost secretaries' pay and get the needed level of multi-lingual fluency from the labour market.
The fourth plank of SID's Platform goes well with the Auditors' warning; "4. ROTTEN PAY ROTTEN WORK; This old IWW proverb was true in the Chicago of 1905 and it is true today."


"Coherence of implementing rules
15. The Court welcomes the proposal that, for the sake of transparency, the Court of Justice should establish a register containing the implementing rules of all institutions and that the Commission should report every three years on rules adopted by each institution to give effect to the Staff Regulations. In addition, the Court recommends that the Commission proposes a procedure for prior consultation in order to avoid cases where divergences in implementing rules from one institution to another result in an unequal treatment of staff."

It is dismaying that the Institution charged with drafting EU legislation is unable to manage its own internal rules and has to call in outside assistance. Notice that another Institution has to remind the draftsmen of European law about equality before the law.



"Addressing geographical imbalances
16. The Commission proposal to address long-lasting and significant geographical imbalances where nationalities are under-represented in comparison with the relative size of their population should be considered with due care. Any such arrangements should respect the principle of equality of EU citizens and the principle that no post is to be reserved for nationals of any specific Member State."

This is a textbook example of austerity versus legality. Median personal income in the wealthiest Member States is twice that of the poorest. Given the two legal principles cited by the Auditors and the impracticality of drafting people into our civil service against their will, there is only way to geographical balance. Benefits must be high enough to attract qualified candidates from the richest Member State, even if this means that our colleagues from the newer Members States will be extremely well off by their national standards. Considering that staff is concentrated in two Member States who are at the top of the pay table with the corresponding rents and prices, there no real problem.

This is probably not a mistake on the part of the neo-con austerity-at-any-price politicians. Believing that market forces automatically solve all of societies' problems, they consider reductions in the quantity and quality of EU staff to be so many steps in the right direction.



"The European Personnel Selection Office
19. Since its creation, the European Personnel Selection Office (EPSO) ( 3 ) has become the main point of contact for EU citizens who wish to work for the European institutions. The current rules on competitions to be organised by EPSO as set out in the Staff Regulations ( 4 ) are rudimentary. Since they were introduced in 2004, a considerable body of case-law has clarified important principles in the selection process, for example with regard to the role of the selection boards or with regard to the use of languages. In the interest of transparency, the Commission should consider proposing the necessary amendments to reflect these clarifications in the relevant provisions of the Staff Regulations."

The word "reform" implies giving a new form or structure. The jurisprudence of the Court of Justice has developed new rules for the recruitment process, which should be incorporated into the new Staff Regulations because these rules already have the force of law. The on going "Reform" is about shrinking the European Civil Service and has nothing to do with reorganizing with a view to making it more efficient.
