Who's Afraid of the Big Bad HR?

This note from the Director General of HR has caused some concern among staff and its unions. Let us take a closer look.

Most of the note is old news, but there are enough bits of new information to make it worthwhile reading. The bulk of the text is perfectly harmless; in fact this writer quite enjoyed being told to exercise "caution, carefulness". Yes, Mother, I'll be a good boy.

There are also a few slightly problematic passages that need to be discussed in order to prevent misunderstandings. We are reminded of our duties under Article 11a;
"Article 11a
1. An official shall not, in the performance of his duties and save as hereinafter provided, deal with a matter in which, directly or indirectly, he has any
personal interest such as to impair his independence, and, in particular, family and financial interests.
2. Any official to whom it falls, in the performance of his duties, to deal with a matter referred to above shall immediately inform the Appointing Authority.
The Appointing Authority shall take any appropriate measure, and may in particular relieve the official from responsibility in this matter.
3. An official may neither keep nor acquire, directly or indirectly, in undertakings which are subject to the authority of the institution to which he belongs or which have dealings with that institution, any interest of such kind or
magnitude as might impair his independence in the performance of his duties." This has nothing to do with Twitter etc.. Is it a simple typographical error? Anyway, nothing to worry about here.

The reference to
"Article 17
1. An official shall refrain from any unauthorised disclosure of information received in the line of duty, unless that information has already been made public or is accessible to the public.
2. An official shall continue to be bound by this obligation after leaving the service." is a repetition of the already familiar rules.

What is misleading; these anodyne legal references are published under the heading of "LOYALTY", all caps, bold font. This has misled some colleagues into imagining that their freedoms of opinion and expression under the Charter of Fundamental Rights have been suspended by the Director General of Human Resources. Setting the record straight; the Charter is part of the highest constitutional law of Europe. The Director General is bound by it, like all of us. Even if an evil tyrant took her post, he could not take away your basic rights.

Some have worried that the note can intimidate EU employees into giving up their fundamental rights because of a vague feeling of being under threat. We can offer two pieces of advice to those who are in doubt about just how far they can go in the social media. First; take a look at some of the stuff here on SID, like Contempt of Court, Contempt of Luxembourg , for an example. You need not worry that SID is somehow protected by powerful interests; we defend our rights with a little legal knowledge and some courage. You have all the rights that we do. Which brings us to the second piece of advice; if you still hesitate about expressing yourself, send us your material and we will take a look, giving you a second opinion. In especially complex cases we will consult our friends at the Court of Justice.

Remember that those who exercise their democratic rights are not alone; many individuals and groups are on their side. One of them is SID.
