COUNCIL DECISION
OF 23 JUNE 1981

establishing a tripartite consultation procedure
concerning relations with staff
__



THE COUNCIL,

Whereas it is desirable, while respecting the competences of the institutions, to develop a consultation procedure within the framework of a committee, hereinafter called the "Consultation Committee", including representatives not only of the Member States and of the staff but also of the administrative authorities of all the institutions and assimilated organs of the Communities, in order in particular to ensure that the views of the staff and the administrative authorities are known to the representatives of the Member States before firm positions are adopted by them and that the Council receives a report from the Committee enabling it to take its decisions in full knowledge of all relevant factors;

Whereas it is also desirable to provide for a conciliation procedure for cases where serious difficulties persist,

HAS ADOPTED THE FOLLOWING PROVISIONS:

I. CONSULTATION IN THE CONSULTATION COMMITTEE

1. Relations between the Council and the staff, represented by the trade union and professional organisations, shall be based on a consultation procedure in which the administrative authorities of the institutions and assimilated organs participate, in the course of which all the available information and the positions of the parties shall be examined with the aim of facilitating as far as possible an alignment of positions and of ensuring that the views of the staff and the administrative authorities are known to the representatives of the Member States before firm positions are adopted by them.

2. (a) The consultations shall take place within a Consultation Committee which shall
consist of:

– a representative of each Member State;
– an equal number of representatives of the staff, designated by the trade union and professional organisations;
– the chief administrative official of each institution (that is to say the Registrar of the Court of Justice and the Secretary General of each of the other institutions) or a person designated by him to represent him.

(b) In its capacity as the institution responsible for the proposal under discussion, the Commission shall designate a person to attend meetings of the Consultation Committee.

(c) For the purposes of these provisions, the Economic and Social Committee, the Committee of the Regions and the Ombudsman of the European Union shall be treated as institutions.


3. The consultation procedure may be applied only to Commission proposals to the Council relating to the amendment of the Staff Regulations of officials of the European Communities or the Conditions of Employment of other servants of the European Communities or relating to the application of the provisions of the said Staff Regulations or the said Conditions of Employment concerning remunerations or pensions. It shall be applied to any such proposal if any member of the Consultation Committee so requests.

4. The chairmanship of the Consultation Committee shall be held by the Secretary General of the Council/High Representative for the common foreign and security policy or by the Deputy Secretary-General? of the Council.

5. Meetings of the Consultation Committee shall be summoned by the Chairman of the Committee, either on his own initiative or at the request of any member of the said Consultation Committee, after the members of the Committee have had a reasonable period within which to familiarise themselves with the matter to be examined.

6. (a) In the case of proposals concerning the application of the provisions of the Staff
Regulations and Conditions of Employment concerning remunerations and pensions, the Consultation Committee shall endeavour to complete its work within a period of four weeks commencing with its first meeting.

(b) In the case of proposals concerning the amendment of the Staff Regulations and Conditions of Employment, the Consultation Committee shall endeavour to complete its work within a period of three months commencing when the opinions of the institutions consulted in accordance with Article 283 of the Treaty establishing the European Community have been received by the Council.

The Consultation Committee shall not commence examination of the proposal until the opinions of the institutions consulted in accordance with Article 283 of the Treaty establishing the European Community have been received by the Council.

7. The Consultation Committee shall draw up a report on the result of its examination of the proposal, which it shall transmit, within the time limit mentioned in paragraph 6, to the Permanent Representatives Committee for submission to the Council.

8. In the course of their work the members of the Consultation Committee shall endeavour to the greatest possible extent to align their positions and thus to permit the submission of a report to the Council setting out common positions. Insofar as this is not possible the report shall set out the different positions.

Procedure at the stage of consideration by the Council

1. The Council shall take its decision on the basis of the Commission proposal, in accordance with the usual procedures and taking into account the report of the Consultation Committee.

2. However, before the Council takes its decision, the President shall meet the representatives of the staff for the purpose of informing them of the likely contents of the Council's decision and permitting them to express their views. In the event of
serious disagreement, the representatives of the staff may request a meeting with the President, accompanied by the members of the Council, in order to explain their point of view.

3. If there continues to be serious disagreement, the staff representatives may request 1 that the matter be submitted to a conciliation procedure. The Council shall decide in accordance with the usual procedures.


II. CONCILIATION PROCEDURE

1. Where a matter is submitted to a conciliation procedure, the Council shall, after consultation with the members of the Consultation Committee representing the staff, appoint a conciliator chosen on the basis of his competence in the area concerned and his complete independence of either party and shall determine his terms of reference.

2. On conclusion of his mission and not later than six weeks after the matter is referred to him, the conciliator shall make his report to the Council, which shall take its decision on the basis of the Commission proposal, in accordance with the usual procedures and taking into account the report by the conciliator. Before the Council takes its decision, the President shall meet the staff representatives for the purpose of informing them of the likely contents of the Council decision and enabling them to express their views. The staff representatives may request 1 a final meeting with the President, accompanied by the members of the Council, to permit them to express their views before the Council decides.

III. REVIEW CLAUSE

The Council may examine at any time, either on its own initiative or at the request of the members of the Consultation Committee representing the staff or of the chief administrative officials referred to in the third indent of section I, paragraph 2(a), the results of the application of these provisions with a view to deciding whether any amendments should be made to them.




ANNEX II


Statement entered in the Council minutes
when the Decision of 23 June 1981 was adopted



"The Council states, for the information of the staff of the Institutions, that in the event of the normal working of the Council being disrupted, the consultation procedure will be automatically suspended.

The Council further states that:
 as a rule, Member States shall be represented on the Consultation Committee by their Deputy Permanent Representatives, on the understanding that the latter could be assisted or, in exceptional cases, replaced by alternates;
 the Consultation Committee shall be empowered to amend the chairmanship rules."
